在过去3个月所批准的92个NIW案件中，大部分（占总人数约87%）申请者拥有博士学位；11个申请者，或者说占总人数12%左右的申请者，提交申请时只拥有硕士学位；只有一位申请者是学士学位。这些申请者中的大多数人从事医学、生物和工程技术研究，其他则专注于计算机、统计、物理、化学以及教育等领域。那些在医学、生物和工程技术领域工作的申请者被迫与大量的申请者竞争。其结果是，移民局只能批准其中最强的申请。

那些拥有“博士后研究员”，“研究科学家/工程师”、“助理教授”或其他类似职衔的人主要从事教学研究工作，撰写论文，以及参加会议等等。由于研究工作的性质，这一类申请者更容易通过客观证据显示他们已经拥有全国性的影响力，易于通过更客观的证据（例如，引用、下载、成果商业化等等）保持过去成就的记录。 当然，即使您觉得缺乏此类证据，也不要泄气。因为，每一个申请都是不同的，移民局能够认可您对美国有内在价值的独特资格和技能，移民局不会仅仅根据具体数据来审核申请。我们事务所的经验丰富的律师将帮助您突出您最强的专业才能，同时淡化您较弱的部分。
另外，我们还从这些案例中总结了其它相关数据。这些申请者的平均发表论文数量是11篇，平均引用次数是113次，申请的平均处理时间是147天或约5个月。批准案件最长的处理时间是483天，最短是1天。

我所上一季度获批的NIW申请的平均处理时间是155天或近5个月。批准案件最长的处理时间是536天，最短是25天。
对于出生在中国大陆的NIW EB-2申请人来说，需要等待较长时间的排期才能递交身份调整申请。不过请注意，如果您的配偶出生在除中国大陆或印度以外的其他国家或地区（包括港澳台三地），您在递交NIW申请时，可借用配偶出生所在地的移民名额，同时递交I-485申请，无需再等待排期。
此外，如果您在NIW批准后做出了更大更重要的成果，也可以考虑申请EB-1。EB-1类别目前有签证名额可用，无需等待排期。不过，EB-1的审理也有变难的趋势，尤其是美国移民局在2010年8月18日出台了一个备忘录之后。从本质上说，该备忘录将EB-1评估过程分为两部分：1） 评估申请者是否符合移民申请类别的标准底线，以及2）决定申请者的证据是否证明申请者达到了移民类别所要求的高水平专业资格。在第2部分审核程序中，移民局将评估全部证据，从整体上看是否能够证明申请者在其领域内是最顶尖的。通俗来说，对于第一步审核，移民局官员着重看申请人在单纯的“量”上是否符合要求，在第二步审核中，移民局官员着重看申请人在总体的“质”上是否符合要求，“量”符合要求了不一定意味着“质”符合要求。
